Proposition 65

What is Proposition 65?

Proposition 65 refers to The Safe Drinking Water and Toxic Enforcement Act of 1986, a law in California that:

  • Requires The Office of Environmental Health Hazard Assessment (OEHHA), part of the California Environmental Protection Agency (CalEPA) to maintain a list of publicly published chemicals that are scientifically proven to “cause cancer, birth defects, and other reproductive harm”, and associated laws, policies, and procedures; to be updated at least once a year.
  • Requires the complete disclosure, by all businesses that sell in California, of all chemicals in a product that, in significant quantity, have the potential to “cause cancer, birth defects or other reproductive harm” by placing warning labels on the product.
  • Prohibits businesses operating in California from knowingly discharging significant amounts of listed chemicals into any source of drinking water.
